QB Union Camp Liability Waiver

This Liability Waiver and Release Agreement is entered into by and between Quarterback Union, Thomas Hand and the undersigned participant or legal guardian of the participant ("Participant" or "Parent/Guardian") in consideration of the Participant’s participation in quarterback training sessions provided by Quarterback Union.

1. Acknowledgment of Risk

I acknowledge and understand that participation in quarterback training involves physical activity, including, but not limited to, exercises, drills, and the use of equipment. I fully understand that such activities may expose the Participant to potential risks, including, but not limited to, sprains, strains, fractures, contusions, concussions, and other injuries and/or death. I voluntarily assume all risks associated with the Participant’s involvement in the training program.

2. Release of Liability

In consideration of the Participant’s involvement in the quarterback training sessions, I, on behalf of the Participant, hereby release, waive, and discharge Quarterback Union, Thomas Hand, its officers, employees, agents, instructors, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, damage, or loss suffered by the Participant during the course of the training program, whether caused by negligence, misconduct, or any other reason.

3. Indemnification

I agree to indemnify and hold harmless Quarterback Union, Thomas Hand, its officers, employees, agents, instructors, contractors, and affiliates from any and all claims, liabilities, losses, damages, expenses, or costs (including legal fees) arising from the Participant’s actions, omissions, or participation in the training program.

4. Medical Consent

I represent that the Participant is in good health and able to participate in the quarterback training sessions. In the event of an injury or medical emergency, I consent to Quarterback Union and Thomas Hand arranging for medical treatment for the Participant, including but not limited to emergency medical care, hospitalization, or transportation to a medical facility, and I agree to assume all costs associated with such treatment.

5. Permission to Use Photo/Video Waiver and Release

I hereby grant QB UNION and its legal representatives the irrevocable right and unrestricted permission to use and publish photographs or video images of my child, or in which my child may be included, for any purpose authorized by QB Union, including but not limited to: website use, social media, editorial publications, catalog and advertising use. I understand that there will be no compensation to me for this use. Furthermore, I understand that I will not be given the opportunity to inspect or approve the finished products or the advertising copy or the printed matter that may be used in connection therewith. In granting this permission to QB UNION and its legal representatives, I am fully and without limitation releasing it from any liability that may arise from the use of the images.

6. Rules and Conduct

I agree that the Participant will abide by all rules and guidelines set forth by Quarterback Union, Thomas Hand, and its instructors during the training program. I acknowledge that failure to follow the rules may result in the Participant being removed from the program without refund.

7. Governing Law

This Agreement shall be governed by, and construed in accordance with, the laws of the state of Texas without regard to its conflict of laws principles.

8. Severability

If any provision of this Agreement is deemed invalid or unenforceable by a court of law, the remaining provisions will remain in full force and effect.

9. Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding the subject matter herein and supersedes all prior or contemporaneous agreements, representations, or understandings, whether written or oral. By signing below, I acknowledge that I have read and understood this waiver, and I voluntarily agree to all terms and conditions stated herein. I understand that this waiver releases Quarterback Union and Thomas Hand from liability for any injury or harm that may occur during the Participant’s involvement in Quarterback Union’s and Thomas Hand's training program.
